Terms & Conditions

By booking lessons with PassWith Driving School Ltd, you agree to the following Terms & Conditions.
1. Bookings
- •All lessons are subject to instructor availability.
- •A lesson is only confirmed once payment has been received.
- •Your first lesson must be paid for in advance to secure your booking.
- •Regular lesson slots are not guaranteed until confirmed by your instructor.
2. Lesson Payments
- •All lessons must be paid at least 48 hours before the lesson is due to start.
- •Lessons that remain unpaid within 48 hours of the lesson may be cancelled and offered to another student.
- •Payments can be made by bank transfer or via the Total Drive app.

3. Cancellation Policy
- •Students must provide at least 48 hours' notice to cancel or rearrange a lesson.
- •Where less than 48 hours' notice is given, the full lesson fee remains payable, and lesson credit will be lost unless agreed otherwise by the instructor.
- •This includes cancellations due to illness, work commitments, college or school, holidays, forgetting the lesson, and transport issues.
4. Instructor Cancellations
- •If your instructor has to cancel due to illness, vehicle breakdown, severe weather, family emergency or other unforeseen circumstances, the lesson will be rearranged as soon as reasonably possible.
- •If PassWith Driving School is unable to provide the lesson within a reasonable period, any prepaid lesson fees for that cancelled lesson will be refunded.
5. Late Arrival
- •If you are late, your lesson will still finish at the original agreed time, and your lesson fee remains payable in full.
- •If your instructor is late, the lost time will either be added onto the lesson where possible, or be made up during a future lesson.
6. Lesson Collection
- •Students must be ready at the agreed collection point.
- •If you change your collection address, you must inform your instructor in advance.
- •If your instructor arrives at the agreed location and you are elsewhere, travel time to your new location will be deducted from your lesson time.
7. Fitness to Drive
- •You must not attend a lesson if you are under the influence of alcohol, under the influence of illegal drugs, impaired by medication, or medically unfit to drive.
- •The instructor reserves the right to refuse or terminate a lesson if they believe it would be unsafe to continue. The lesson fee remains payable.
8. Driving Licence
- •Before your first lesson you must hold a valid UK provisional driving licence, produce your licence when requested, and provide permission for DVSA licence checks where required.
- •Failure to do so may result in the lesson being cancelled.
9. Behaviour
- •Students are expected to treat instructors and vehicles respectfully.
- •The instructor reserves the right to terminate a lesson immediately if a student behaves aggressively, is abusive, threatens staff, damages the vehicle, or refuses to follow reasonable safety instructions. No refund will be given.
10. Mobile Phones
- •Mobile phones must not be used whilst driving unless instructed by your instructor as part of your training.
11. Smoking & Vaping
- •Smoking and vaping are not permitted inside the tuition vehicle.
12. Food & Drink
- •Hot food is not permitted during lessons. Drinks with secure lids are acceptable.
13. Vehicle Cleanliness
- •If excessive cleaning is required due to sickness or deliberate damage, PassWith Driving School reserves the right to charge the reasonable cleaning or repair costs.
14. Driving Tests
- •Driving test bookings remain the responsibility of the student unless otherwise agreed.
- •Use of the tuition vehicle for a driving test is subject to the instructor being satisfied the student has reached the required standard, and the vehicle being available.
- •PassWith Driving School reserves the right to refuse use of the vehicle if it is considered unsafe or unlikely that the student would meet the DVSA standard.
15. Lesson Length
- •Standard lessons are normally 1 hour or 2 hours. Lesson lengths may vary by agreement.
16. Gift Vouchers
- •Gift vouchers are non-refundable, cannot be exchanged for cash, and must be used before the expiry date shown.
17. Tuition
- •PassWith Driving School currently provides tuition in automatic and manual vehicles.
- •Passing a practical driving test in an automatic vehicle entitles the holder to drive automatic vehicles only unless a further practical test is passed in a manual vehicle.
18. Total Drive App
- •Students will receive access to the Total Drive app. The app is used for lesson bookings, payments, progress records, appointment reminders, and instructor communication.
- •Students are responsible for keeping their contact details up to date.
19. Data Protection
- •Personal information is processed in accordance with UK GDPR and applicable data protection legislation.
- •Information is used solely for providing driving tuition, lesson administration, and legal obligations. Information is never sold to third parties.
20. Liability
- •PassWith Driving School accepts no responsibility for driving test cancellations by DVSA, delays caused by traffic, weather-related disruptions, or circumstances outside our reasonable control.
21. Complaints
- •If you are unhappy with any aspect of your tuition, please contact PassWith Driving School Ltd.
- •We aim to acknowledge complaints within 5 working days and investigate them fairly.
23. Lesson Prices
- •PassWith Driving School Ltd reserves the right to review and amend lesson prices at any time.
- •Any price increase will not affect lessons that have already been paid for in advance. Future lessons and bookings will be charged at the current published rate.
- •Students will be given reasonable notice of any changes to lesson prices.
24. Dashcams & Vehicle Telematics
- •For the safety and security of both students and instructors, tuition vehicles may be fitted with forward-facing dash cameras, rear-facing dash cameras, interior-facing cameras, GPS tracking, and vehicle telematics.
- •Recordings and data may be used for investigating road traffic collisions or incidents, insurance claims, complaints or disputes, protecting both the instructor and student, improving driving performance and lesson quality, and preventing fraudulent or malicious claims.
- •All recordings are processed in accordance with UK GDPR and applicable data protection legislation. Footage will only be shared where legally required or where necessary for insurance, law enforcement or dispute resolution.
25. Refund Policy
- •Refunds are issued at the sole discretion of PassWith Driving School Ltd unless otherwise required by law.
- •Where a refund is approved, refunds will be returned to the original payment method wherever possible, and may take up to 15 working days to be processed.
- •Chargebacks or payment disputes may delay the refund process. Any lessons already delivered will be charged at the standard lesson rate before any remaining balance is refunded.
- •Block booking discounts are offered on the basis that the full course is completed. If a block booking is cancelled before completion, any lessons already taken will be recalculated at the current standard pay-as-you-go rate before any refund is issued.
26. Regular Weekly Lesson Slots
- •While PassWith Driving School aims to provide students with a regular weekly lesson slot, this cannot be guaranteed indefinitely.
- •The instructor reserves the right to amend lesson days or times where reasonably necessary due to driving test bookings, instructor holidays, vehicle maintenance, changes in student availability, business requirements, or operational efficiency.
- •Where possible, reasonable notice will be given of any permanent timetable changes.
27. Communication
- •Students are expected to maintain reasonable communication with PassWith Driving School.
- •Important information, including lesson reminders, timetable changes, payment requests and account updates, may be sent by SMS, telephone, email, Total Drive app notifications, or WhatsApp (where applicable).
- •It is the student's responsibility to ensure their contact details remain accurate and up to date.
28. Force Majeure
- •PassWith Driving School Ltd shall not be liable for delays, cancellations or failure to provide lessons where caused by circumstances beyond its reasonable control, including but not limited to severe weather, flooding, snow or ice, road closures, mechanical failure, government restrictions, public emergencies, industrial action, or illness or injury affecting the instructor.
- •In such circumstances, lessons will be rearranged at the earliest reasonable opportunity.
29. Governing Law
- •These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
- •Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
30. Zero Tolerance Policy
- •PassWith Driving School Ltd operates a zero-tolerance policy towards abusive, threatening, discriminatory or inappropriate behaviour towards instructors, staff or other students. This includes behaviour in person, over the telephone, by email, social media or messaging applications.
- •PassWith Driving School reserves the right to immediately terminate tuition and cancel any future bookings where such behaviour occurs. Any outstanding lesson fees will remain payable, and no refund will be issued for prepaid lessons unless required by law.
31. Transfer of Lesson Credit Between Instructors
- •PassWith Driving School Ltd understands that, on occasion, students may wish to change instructors.
- •Where another suitable instructor is available within PassWith Driving School Ltd, any unused lesson credit may be transferred to that instructor, subject to availability and acceptance by the receiving instructor.
- •The transfer of lesson credit will not incur any additional administration fee, is subject to the new instructor's availability and lesson rates, may require payment of any difference in lesson price if the receiving instructor charges a higher hourly rate, and does not guarantee immediate availability or a regular weekly lesson slot.
- •Any lessons already completed with the original instructor remain non-transferable and are deemed to have been used.
32. Acceptance
- •By booking and paying for lessons with PassWith Driving School Ltd, including through the Total Drive app, you confirm that you have read, understood and accepted these Terms & Conditions.
