These terms apply to driving tuition booked with PassWith Driving School Ltd ("PassWith", "we", "us"). "You" means the learner or, where applicable, the person paying for lessons. If someone else pays, the learner must still comply with the lesson and safety rules. We will make these terms available before booking. The terms in force when a booking is confirmed apply to that booking. Nothing in these terms limits your statutory rights.
1. Bookings and availability
Lessons are subject to instructor, vehicle and timetable availability. A booking is confirmed only when your instructor or PassWith confirms the date and time and any payment required to secure it has been received. A requested slot, recurring time or app listing is not a confirmed booking. We may decline a booking where we cannot safely or reasonably provide it. Lessons are normally conducted in the instructor's tuition vehicle; teaching in a learner's own vehicle requires separate prior written agreement and suitable insurance.
2. Prices and payment
The price and lesson length will be confirmed when you book. The first lesson must be paid for when booked. Later lessons must be paid at least 48 hours before their scheduled start, unless we agree otherwise in writing. Block bookings and intensive courses are payable upfront unless we agree a different arrangement. We may release an unpaid slot after notifying you; cancelling an unpaid slot does not remove a fair charge already due under section 3.
Payment may be made by bank transfer or through Drive Day. Any app transaction fee will be shown before payment. Please use the learner's full name as the bank transfer reference. Current payment details will be provided with the booking or invoice; please verify any change of bank details directly with us before paying.
3. Learner cancellations, changes and missed lessons
Tell your instructor through Drive Day or another agreed channel if you need to cancel or move a lesson. At least 48 hours' notice before the scheduled start allows you to rearrange without a cancellation charge, subject to availability. Where less notice is given, or you do not attend, we may charge up to the full lesson price to cover the loss of the reserved slot. We will take reasonable steps to reduce that loss, including offering the slot to another learner where practicable, and will not charge more than our reasonable net loss. A successfully rebooked slot will be taken into account. The reason for cancellation, including illness, work, school or transport, does not automatically waive the charge, but we may consider exceptional circumstances.
If you arrive late, the lesson normally ends at the booked time and the full fee remains due. If you are absent at the agreed pickup point, the instructor will contact you using the details provided and may leave after 10 minutes. A lesson lost as a result is treated as a late cancellation, subject to the fair-charge rule above. A refund of a prepaid lesson, rather than credit, may be requested where you are entitled to one.
4. Instructor cancellations and delays
An instructor may need to cancel or rearrange because of illness, a vehicle fault, unsafe conditions, an emergency or another reasonable cause. We will notify you as soon as practicable and offer a suitable replacement lesson. If we cannot provide the paid lesson within a reasonable time, you may request a refund for that lesson. If the instructor is late, we will make up the lost teaching time during that lesson where possible or arrange equivalent time at a mutually convenient date. Where that cannot reasonably be done, we will refund the value of the time not provided. We are not responsible for unrelated costs such as lost earnings or travel, except where the law requires otherwise.
5. Collection points and contact details
You must be ready at the agreed pickup point. Tell the instructor of any pickup or drop-off change in good time and update your details in Drive Day. A different location is subject to the instructor agreeing that it is practical. If you are not at the agreed point, travel to a newly agreed location may count towards your booked lesson time, provided the instructor tells you before making the change. Keep your telephone number and other booking details current.
6. Licence, eyesight and fitness to drive
Before driving, you must hold the correct valid licence or provisional entitlement, meet the legal eyesight standard and satisfy any applicable licence conditions. You must show your licence and provide details for lawful checks when reasonably requested. Tell your instructor promptly about any change affecting your entitlement, health or ability to drive safely. Do not attend a lesson impaired by alcohol, drugs, medication, fatigue or a medical condition. The instructor may refuse to start or may stop a lesson if they reasonably consider it unsafe or unlawful to continue. Where the issue was within your control or you failed to disclose relevant information, section 3's fair-charge rule applies. Where the issue was outside your control, we will assess the circumstances fairly and preserve your legal rights.
7. Conduct and vehicle care
Treat the instructor, any accompanying person and the vehicle respectfully. Follow lawful safety directions. The instructor may stop a lesson for threatening, abusive or discriminatory behaviour, deliberate damage, or refusal to follow a necessary safety instruction. This applies to conduct in person and through messages or social media. We may also decline future bookings following serious or repeated conduct of this kind. We may recover the reasonable cost of deliberate damage or cleaning made necessary by avoidable soiling, supported by appropriate evidence. We will account fairly for any unused prepaid tuition and any loss caused by the learner's conduct; prepaid lessons are not automatically forfeited.
Do not use a hand-held phone while driving. Smoking and vaping are not allowed in the vehicle. Hot food is not permitted; drinks must have secure lids. Tell the instructor before bringing a passenger or child. Any passenger is subject to the instructor's prior agreement, a suitable seat and restraint, insurance and safe operation of the lesson.
8. Lesson length and tuition
Lesson lengths, including 1, 1.5 and 2 hours, are agreed at booking. Teaching may include briefing, practice, feedback and review. Lesson routes and content are selected by the instructor with regard to your progress, goals, road conditions and safety. We offer automatic and manual tuition where an appropriate instructor and vehicle are available. Passing a practical test in an automatic car gives entitlement to drive automatic vehicles only; a manual practical test is required to obtain manual car entitlement.
9. Trainee observers and instructor development
An authorised trainee driving instructor or instructor trainer may occasionally observe a lesson for training or quality purposes. We will tell you who will attend and normally give at least 24 hours' notice by Drive Day, text, WhatsApp, email or another agreed channel. The observer will normally sit in the rear, will not instruct you or take part in your lesson, and your allocated instructor remains responsible throughout. We will not arrange observation if a safe, legal seat is unavailable. Any active teaching by the trainee requires your separate advance agreement.
Tell us promptly if you object to an observer or have a reason why their presence would affect your lesson. We will consider reasonable concerns and any adjustment required by law. Where the observer's attendance was clearly notified and agreed as part of the booking, and you withdraw that agreement too late for the reserved slot to be reallocated, the instructor may decline to conduct the lesson without the observer and section 3's fair cancellation charge may apply. If we give less than 24 hours' notice, you may decline the observer and receive your lesson with the allocated instructor, or, if that cannot be provided, rearrange or obtain a refund for the affected lesson. An observer has no right to film or publish your lesson simply by attending.
10. Driving tests and test-day vehicle hire
You are responsible for booking and paying DVSA for your test unless we expressly agree otherwise. By law, only the candidate can book, change, swap or cancel a car driving test — we cannot do this for you. Booking a test does not automatically reserve an instructor or car; arrange test-day hire separately and confirm its price and duration. We may refuse use of a tuition vehicle where the instructor, exercising reasonable professional judgment, considers that the learner is not safe or ready to drive independently, lacks the required entitlement, or where the vehicle cannot lawfully or safely be used. We will explain the reason and give as much notice as reasonably possible so you can consider your options. We will not cancel or move your DVSA test without your agreement. Where we cannot provide the booked car through our own fault, prepaid charges for the service not provided will be refunded. A DVSA cancellation is governed by DVSA's own rules; we will refund any PassWith service not provided, less any fair and clearly disclosed loss where applicable.
On test day, we will: ensure you know how to find the test centre; make sure you arrive in good time with the correct documentation; ensure the vehicle is roadworthy, legally insured, fitted with an extra interior rear-view mirror and correctly positioned L plates; and agree with you beforehand whether we accompany you on the test. We will not interfere with or distract you during the test — the examiner will stop the test immediately if this occurs. After the test, we will use the examiner's debrief to identify areas to focus on in future lessons. We will behave professionally at all times when accompanying you at the test centre.
11. Drive Day, check-in and communications
Drive Day is used for bookings, payments, lesson records, progress and messages. Check in through the app 24 hours before a lesson when requested. If you have difficulty accessing it, contact your instructor by another agreed method. Failure to check in may lead us to contact you and, after reasonable attempts to confirm attendance, release the slot; any charge will follow section 3 and the circumstances. We may send booking and account messages by app, SMS, WhatsApp, email or telephone. App reminders are a convenience; you remain responsible for confirmed bookings. Service communications are separate from marketing, for which any required choice or consent will be handled separately.
12. Blocks, intensive courses and unused credit
The number of hours, total price, any included test-day car hire, course timetable and any special conditions will be confirmed before you pay. A block or intensive purchase does not guarantee a particular test date or instructor. Unused hours remain available for mutually agreed bookings, subject to instructor availability and any clearly disclosed, reasonable validity period. If you end a block early, we may calculate lessons already delivered at the standard rate disclosed when you bought the block, but only where that calculation and any other fair, evidenced loss do not exceed what the law permits. We will refund any balance due after that calculation. We will not impose a flat forfeiture of all unused hours. If we cannot deliver the remaining tuition within a reasonable period, you may request a refund for the undelivered portion. Statutory cancellation rights, where applicable, take priority over this section.
13. Gift vouchers
Voucher value, any restrictions and a reasonable expiry date will be stated at purchase. A voucher cannot normally be exchanged for cash after any applicable statutory cancellation period, but statutory rights remain unaffected. If we cannot honour the voucher or provide the purchased tuition within a reasonable time, we will offer an appropriate refund. A voucher's terms cannot remove rights arising from faulty or undelivered services.
14. Prices and recurring slots
We may change advertised prices for new bookings after giving reasonable notice. A price change will not increase the price of a lesson or package already paid for. A regular weekly slot is an arrangement we will try to maintain, but future lessons remain subject to confirmation. We will give reasonable notice of material timetable changes and discuss alternatives. If we cannot provide a paid future lesson, section 4 applies.
15. Changing instructors and transferring credit
You may ask to change instructor. Where another PassWith instructor accepts the booking and has availability, unused credit can be transferred without an administrative transfer fee. We will tell you of any difference in rates before you agree; credit will be applied by value, and any extra payment requires your agreement. A transfer does not promise immediate availability. If no suitable transfer or other reasonable way to use the credit is available, we will assess a refund under section 12 and your statutory rights.
16. Refunds
Request a refund by contacting PassWith with the learner's name and booking details. We will explain any proposed deduction and calculate it in accordance with these terms and the law. Where a refund is due, we will return it to the original payment method where practicable, normally within 15 working days of agreeing the amount, and sooner where law requires. A chargeback does not remove either party's rights. We will not withhold a refund merely because a complaint or payment dispute has been raised. No fixed administration fee applies unless its amount and basis were clearly disclosed before purchase and it is fair and lawful.
17. Distance bookings and statutory cancellation rights
Bookings made online, by app, telephone or message may carry additional cancellation rights under consumer law, depending on the type of contract and the circumstances. We will provide the required pre-contract information and any applicable cancellation instructions before you commit. If you ask us to start a service during a statutory cancellation period, you may have to pay a proportionate amount for the service actually supplied where the legal conditions are met. Nothing in the 48-hour lesson rule, block terms or voucher terms overrides a statutory right to cancel or obtain a remedy.
18. Recording, tracking and privacy
Tuition vehicles may use outward-facing and, where separately notified, inward-facing cameras, GPS tracking and vehicle telematics. We will tell you which systems are in use and provide a privacy notice explaining the purposes, lawful basis, retention, access and your data rights. These systems may support safety, incident investigation, insurance, lesson records and the fair resolution of disputes. Audio or interior recording will be identified specifically. Footage or data will be shared only where there is a lawful basis, such as with insurers, police, regulators or professional advisers when necessary. We do not sell learner personal information. A recording does not replace the instructor's duty to provide tuition with reasonable care and skill. Direct privacy requests to the contact details in our separate privacy notice.
19. Responsibility and events outside our control
We will provide our services with reasonable care and skill. We cannot guarantee a test pass, a test date, uninterrupted travel or a particular traffic condition. We are not responsible for DVSA decisions or events genuinely outside our reasonable control, but we will take reasonable steps to notify you, reduce disruption and rearrange or refund tuition we cannot provide. Nothing excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded, or restricts your statutory remedies.
20. Complaints
Please raise a concern with your instructor or contact PassWith Driving School Ltd through the contact details provided on your booking confirmation or website. Complaints are handled in accordance with our Complaints Procedure, which sets out the applicable acknowledgement and response times. If you are not satisfied with our response, you can also complain about a driving instructor to the DVSA at gov.uk/complain-about-a-driving-instructor. Raising a complaint does not affect your statutory rights.
21. Changes to these terms
We may update these terms for future bookings. Material changes affecting lessons already paid for require your agreement unless a change is required by law or does not disadvantage you. An updated version will show its effective date and will be made available before it applies to a new booking.
22. Governing law
These terms are governed by the law of England and Wales. This does not take away any mandatory consumer protection or right to bring proceedings in a court available to you under applicable law.
23. Acceptance
By confirming a booking after these terms have been made available, you agree to the terms applicable to that booking. We may ask you to acknowledge them in Drive Day. Your statutory rights remain unaffected.
24. Instructor code of practice
Our instructors adhere to the DVSA's Driving Instructor Code of Practice, which sets out the standards of conduct, professionalism and safeguarding expected of all approved driving instructors and trainee licence holders. This includes maintaining professional boundaries, protecting pupils from harm (especially those under 18 and vulnerable adults), providing instruction in line with the national standard for driver and rider training, and behaving honestly and with integrity at all times. You can read the full code of practice on the DVSA website at gov.uk. If you have concerns about an instructor's conduct, you can raise them with us through our complaints procedure or report them directly to the DVSA.
